1. What is the Owner's recourse under AIA Document A201-2017 if the Contractor defaults or neglects to carry out the Work in accordance with the Contract Documents?

Before undertaking any action to remedy the deficiencies, the Owner is required to initiate arbitration or other formal dispute resolution processes in order to avoid breaching the Contractor’s scope of responsibility under the Contract Documents.

Even in the event of the Contractor's default or failure to perform the Work, the Owner is not contractually permitted to intervene directly or carry out corrections without first pursuing legal remedies or formal dispute resolution as specified in the Agreement.

The Owner must observe a mandatory waiting period of at least thirty calendar days after issuing formal written notice to the Contractor before initiating any corrective action on their own, regardless of the urgency or severity of the issue.

If the Contractor fails to commence and continue correction of the default or neglect diligently and promptly within ten days of receiving written notice, the Owner may correct such deficiencies.
